Terms of Service

1. Agreement

These terms are an agreement between you and BabyStory for use of the BabyStory website at babyfuturestory.com. By using the service you accept them. If you do not accept them, do not use the service.

2. Who may use it

You must be at least 18 years old and legally able to enter this agreement. You may only upload a photo of someone else — including a child — if you are their parent or guardian, or you have their explicit permission (or, for a child, their guardian's).

3. What the service produces

BabyStory generates imagined images and videos from the photos and options you provide. A generated baby portrait is an artistic blend of facial features made by a machine. It is not a genetic prediction, a medical or diagnostic result, or a statement about any real future child. The service is provided for personal, entertainment and keepsake purposes.

4. Accounts

You are responsible for keeping your password confidential and for activity under your account. We may suspend or close an account that we reasonably believe is being used for abuse, fraud or a breach of these terms.

5. Credits and payments

• Your first baby photo each month is free. An email address is required; a payment card is not.
• Further images and all baby videos use credits. Credits are sold as one-time packs; there is no subscription and no automatic renewal.
• Payments are processed by Dodo Payments (merchant of record), which acts as the merchant of record and is the legal seller of the credits. Its checkout, receipt, tax handling and refund policy apply to the transaction.
• Credits are added to your account after the payment provider confirms success. If a generation fails, the credit used for that attempt is returned automatically.
• Credits have no cash value, cannot be transferred, and expire only where required by law or stated at purchase.

6. Acceptable use

You must not use the service to:

• create or request sexual content involving minors, or any content that sexualises a child;
• depict a real person in a sexual, defamatory, harassing or deceptive way;
• generate content designed to deceive, such as fake announcements presented as genuine news or a real medical or genetic claim;
• upload a photo of a person who has not consented to this use;
• infringe anyone's intellectual property or privacy rights;
• bypass free-use limits, automate the service, or interfere with its operation or security;
• break any law that applies to you.

We may remove results and suspend access where we reasonably believe this section has been breached, and we cooperate with lawful requests from authorities.

7. What you warrant

By using the service you represent and warrant that:

• you are at least 18 years old and legally able to enter this agreement;
• you own every photo you upload, or you hold all permissions needed to use it — including the explicit permission of a parent or guardian for any photo of a child;
• the photos do not infringe anyone's copyright, privacy, image rights or other rights;
• you will not present a generated result as a real photograph, a genetic prediction, a medical assessment, or the likeness of a real person who has not agreed to it;
• your use of the service complies with every law that applies to you.

8. Indemnity

You agree to indemnify and hold BabyStory harmless against any claim, demand, loss, liability, cost or expense (including reasonable legal fees) arising out of or connected with: the photos you upload, your use of a generated result, your breach of these terms, or your infringement of another person's rights. This obligation survives the end of your use of the service.

9. Moderation and removal

We may refuse a request, remove a result, or suspend or close an account without prior notice where we reasonably believe that content or activity breaches these terms, our acceptable use rules, or applicable law, or where a provider or payment partner requires it. We are not obliged to store, return or restore content that we remove under this section.

10. Chargebacks and abuse

Fraudulent chargebacks, deliberate credit abuse, attempts to bypass free-use limits, or automated or scripted use of the service may result in immediate suspension, and we may recover the reasonable costs of investigating and disputing them.

11. Your content

You keep ownership of the photos you upload and of the results generated from them. You grant us the limited permission needed to transmit your photos to our processing providers and return the result to you. We do not publish your photos, and we do not use them to train our own models.

12. Our content

The site design, text and software are ours or our licensors'. These terms do not grant you any right to copy or resell them.

13. Availability and changes

The service is provided as-is and can change. Generation depends on third-party AI providers, so a request can fail or take longer than usual. We may add, modify or withdraw features, and we aim to give reasonable notice of material changes that affect paid credits.

14. Disclaimers

To the extent permitted by law, the service is provided without warranties of any kind, including fitness for a particular purpose. Nothing in these terms excludes rights you have as a consumer that cannot be excluded by law.

15. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of data or profits. Where liability cannot be excluded, our total liability for a claim is limited to the amount you paid us in the twelve months before the claim arose.

16. Governing law

These terms are governed by the laws of the jurisdiction in which the operator of BabyStory is established, without affecting consumer protections you are entitled to where you live.

17. General

If any part of these terms is found unenforceable, the rest remains in force. Failure to enforce a provision is not a waiver of it. You may not transfer your rights under these terms without our written consent; we may transfer ours to a successor of the service. These terms, together with the Privacy Policy and the terms of our payment provider, are the entire agreement between you and us about the service.
